Section 1 – Provisions

1. Friend: Engaged persons by Professional Friendship, aged 21 or older, providing services during a booking. These individuals are represented by Professional Friendship at all times.

2. Customer: A legal or natural person aged 18 or older who wishes to engage in a booking agreement with Professional Friendship or has already entered into such an agreement.

3. Parties: Professional Friendship and the Customer together.

4. Professional Friendship: A business located in Victoria, Australia.

5. The Website: Refers to www.professionalcompanionship.com.

6. Booking: An agreement of order, provided services, and all other agreements between the Customer and Professional Friendship, including the Booking of an Arrangement.

7. Arrangement: A set of provided services based on the Customer’s wishes and consultation with Professional Friendship.

8. Booking Confirmation: A confirmation issued by Professional Friendship to the Customer where the arrangements are defined.

9. Booking Request: Every request by the Customer to Professional Friendship made via the website, email, phone, or any other communication means, signifying an intention to use Professional Friendship’s services.

Section 2 – Applicability

1. These terms apply to all offers, bookings, and related legal relations. Deviations are valid only if explicitly approved in writing by Professional Friendship.

2. Professional Friendship reserves the right to unilaterally adjust the content of these terms.

3. The applicability of any terms and conditions from the Customer is expressly ruled out.

4. By entering a booking, the Customer agrees to the exclusive applicability of these terms unless explicitly agreed otherwise in writing.

5. If any provision in these terms is invalid or unenforceable, the remaining provisions remain fully applicable.

6. Customers who have previously made a booking with Professional Friendship implicitly agree to these terms for subsequent bookings.

Section 3 – Company

Professional Friendship is a legal, high-class Friendship service. All companions are carefully selected, perform services out of free will, and are at least 21 years old, in compliance with Australian legislation.
Section 4 – Booking Process

1. All offers by Professional Friendship are non-binding unless otherwise stated.

2. A booking is confirmed only upon explicit acceptance of the Booking Request by Professional Friendship.

3. Bookings replace all prior communications or agreements.

4. Professional Friendship reserves the right to decline Booking Requests without providing a reason.

Section 5 – Booking Terms

1. Professional Friendship endeavors to coordinate bookings to offer the best possible experience.

2. Security may be provided for Friends if necessary.

3. Bookings require a minimum duration of two (2) hours.

4. Bookings must occur in hygienic premises such as residential buildings or accommodations rated at least four stars.

5. Customers must maintain a high degree of personal hygiene during the booking.

Customer Obligations During Bookings:

• Ensure the Friend’s safety and Professional Companionship’s reachability.

• Refrain from possessing or offering drugs, excluding alcoholic beverages.

• Behave respectfully and avoid coercing the Friend into actions outside the agreed terms or unlawful activities.

Failure to comply with these obligations may result in penalties, including additional fees and fines as outlined in Section 5.10.
Section 6 – International Bookings

1. International Bookings adhere to standard terms unless otherwise specified here.

2. Booking Requests must be submitted at least 24 hours in advance for bookings within Australasia and 48 hours for bookings outside Australasia.

3. Minimum booking durations:

   • 8-12 hours for cities requiring overnight stays.

   • 24-48 hours for destinations outside Australasia.

4. A 40% deposit is required for all international bookings.

5. Remaining payments (60%) must be completed at least 48 hours before the Friend’s arrival.

Section 7 – Cancellations by Professional Friendship

Professional Friendship may cancel bookings due to Friend unavailability, unsafe conditions, or non-compliance by the Customer. In such cases, efforts will be made to communicate promptly with the Customer.

Section 8 – Cancellations by the Customer

1. Customers must inform Professional Friendship promptly regarding booking changes or cancellations.

2. Cancellations within 24 hours of the booking may result in forfeiture of payments unless force majeure applies.

3. Changes during the booking require explicit consent from the friend, and any additional costs must be settled beforehand.

Section 9 – Prices and Payment

1. Prices are listed in AUD and exclude taxes.

2. Discounts apply only when explicitly agreed upon and confirmed in the Booking Confirmation.

3. Payments are required in advance or at the start of the booking.

4. Late payments or cancellations may incur additional fees as outlined in Section 10.

Section 10 – Discretion and Liability

1. Customer information is treated confidentially and used solely for service purposes.

2. Professional Friendship is not liable for damages unless caused by intentional misconduct.

3. Liability is limited to the net booking amount.

Section 11 – Intellectual Property

All website content and materials are the intellectual property of Professional Friendship. Unauthorized use is prohibited.
Section 12 – General Provisions

1. Professional Friendship does not guarantee customer satisfaction, given the personal nature of the services.

2. These terms and conditions constitute the entire agreement between the parties and supersede prior communications.
